Terms of Service

These Terms are the agreement between you and Persona. They also serve as the End User License Agreement (EULA) for the Persona app. Please read them — especially the age requirement, the zero-tolerance safety rules, and the arbitration section.

The short version

You must be 18+. There is zero tolerance for objectionable content and abusive users — we remove them, typically within 24 hours. Subscriptions are billed by Apple and auto-renew until canceled. Disputes are resolved by binding arbitration. The full terms are below.

Welcome to Persona. These Terms of Service ("Terms") are a binding agreement between you and Persona ("Persona", "we", "us"), and constitute the End User License Agreement for the Persona mobile application (the "App", together with the website and related services, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance & eligibility

Persona is an adult dating service. You must be at least 18 years old to create an account or use the Service. We verify date of birth at signup and may remove any account we believe belongs to a person under 18. By using the Service you represent that you are 18 or older, that you can form a binding contract, and that you are not barred from using the Service under applicable law or a registered sex offender.

2. Your license to use Persona

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on an Apple-branded product that you own or control, and to use the Service for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, resell, or exploit the Service except as expressly permitted.

3. Zero tolerance for objectionable content and abusive behavior

Zero tolerance

There is zero tolerance for objectionable content and abusive users on Persona. By using the Service you agree that you will not post, upload, send, or share any content that is unlawful, sexually explicit, pornographic, harassing, threatening, hateful, violent, or otherwise objectionable, and that you will not harass, abuse, threaten, or impersonate any other user.

You must accept these Terms before creating or sharing any content. We provide content filtering, in-app reporting of any message, photo, or person, and one-tap blocking throughout the Service. We review reports of objectionable content and abusive behavior and act on them — including removing the content and ejecting the user responsible — typically within 24 hours. Our Community Guidelines describe what is and isn't allowed in detail.

4. Your account

You are responsible for the accuracy of your profile and for all activity on your account. Keep your credentials secure. You may not create an account for anyone else, use another person's identity or photos, or maintain more than one account to evade enforcement.

5. Acceptable use

You agree not to:

  • Post nudity, sexually explicit, or pornographic material.
  • Harass, bully, threaten, defame, or impersonate anyone.
  • Post content that is hateful, discriminatory, or promotes violence or illegal activity.
  • Solicit money, run scams, spam, or advertise.
  • Collect or misuse other users' information, or attempt to circumvent safety features.
  • Use the Service if you are under 18 or a registered sex offender.

6. Content you share

You retain ownership of the content you create. You grant us a limited, worldwide, royalty-free license to host, store, display, and process that content solely to operate, secure, and improve the Service. You are solely responsible for the content you share and its consequences, and you represent that you have the rights to share it. We may remove content that violates these Terms.

7. AI avatars

Persona uses artificial intelligence to build an avatar that represents you and to generate conversations between avatars. Avatar messages are AI-generated and may not perfectly reflect any person. You remain responsible for how you use the Service, and every match is presented for you to review before you choose to engage. See how AI processing works in our Privacy Policy.

8. Safety

Persona provides tools to help you stay safe, but we do not conduct criminal background checks and cannot guarantee the conduct of any user. Always use good judgment when interacting with or meeting others, and review our Safety Center. Report anyone who makes you uncomfortable.

9. Subscriptions & payments

Some features may be offered as an auto-renewable subscription purchased through the Apple App Store. If you subscribe:

  • The subscription title, length, and price per period are shown at purchase.
  • Payment is charged to your Apple ID at confirmation of purchase.
  • The subscription automatically renews for the same period at the same price unless you cancel at least 24 hours before the end of the current period.
  • You can manage or cancel anytime in iPhone Settings → your Apple ID → Subscriptions. Deleting the app does not cancel a subscription.
  • Payments are final except where required by law; refunds are handled by Apple under the App Store terms.

Your use of subscriptions is also governed by this agreement and our Privacy Policy.

10. Termination

You may delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination will survive.

11. Disclaimers & limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any match will result in a relationship. To the fullest extent permitted by law, Persona and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service; and our total liability will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100.

12. Indemnification

You agree to indemnify and hold Persona harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or the rights of others.

13. Governing law & dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Please read this section carefully — it affects how disputes are resolved.

You and Persona agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court. You and Persona waive the right to a jury trial and the right to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@persona-us.com. Nothing in this section prevents either party from seeking injunctive relief to protect intellectual property or safety.

14. Apple-specific terms

This section applies when you use the App obtained from the Apple App Store, and you acknowledge and agree that:

  • These Terms are between you and Persona only, not with Apple. Persona, not Apple, is solely responsible for the App and its content.
  • Your license to use the App is limited to a non-transferable license to use it on Apple-branded products you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the App. Persona is solely responsible for support; contact support@persona-us.com.
  • Persona, not Apple, is responsible for any product warranties, whether express or implied. In the event of any failure of the App to conform to any warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation.
  • Persona, not Apple, is responsible for addressing any claims relating to the App, including product-liability, legal, or regulatory claims, and claims that the App fails to conform to legal requirements.
  • Persona, not Apple, is responsible for investigating and resolving any third-party intellectual-property infringement claim relating to the App.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government restricted-parties list (legal compliance).
  • You must comply with applicable third-party terms when using the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

15. Changes

We may update these Terms from time to time. We'll post the updated version here with a new effective date and, for material changes, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
