Law Enforcement Guidelines
Persona is committed to user safety and to responding appropriately to valid legal requests from law enforcement. These guidelines explain how government and law enforcement authorities can request user information from Persona, the legal process we require, and how we handle emergencies and user notice.
Send valid legal process to lawenforcement@persona-us.com from an official government or agency email. We require proper legal authority appropriate to the data sought, and we narrowly disclose only what the law requires. We practice data minimization, so the information we hold may be limited.
These guidelines are intended for law enforcement and government authorities seeking information from Persona ("Persona", "we", "us") in connection with an investigation. They describe the process we follow when we receive requests for user data through the Persona mobile app and this website.
1. How to submit a request
Send all requests to lawenforcement@persona-us.com from an official government or agency email address. To help us locate the correct records and respond promptly, your request should include:
- The name of the requesting agency and the requesting officer.
- A callback phone number and an official email address where we can reach you to verify the request.
- The legal process supporting the request (such as a subpoena, court order, or search warrant).
- Enough detail to identify the account at issue and the specific information sought.
Requests that do not come from an official government or agency email, or that lack proper legal process, may be delayed or declined pending verification.
2. Legal process we require
The legal process required depends on the type of information sought. In general, we require a subpoena, court order, or search warrant, as appropriate to the data requested, issued under applicable law by an authority with proper jurisdiction. More sensitive information requires a higher level of legal process.
Requests from authorities outside the United States should be submitted through a Mutual Legal Assistance Treaty (MLAT), letters rogatory, or another recognized mechanism for cross-border legal cooperation, unless an applicable law or agreement provides otherwise.
3. Emergency requests
In situations involving an imminent risk of death or serious physical harm to any person, law enforcement may submit an Emergency Disclosure Request to lawenforcement@persona-us.com. The request should describe the nature of the emergency, the specific danger, the person at risk, and the information needed to address it.
Where we have a good-faith belief that an emergency involving imminent risk of death or serious physical harm requires disclosure without delay, we may voluntarily disclose limited information to help address that emergency. Emergency disclosure is at our discretion and does not replace the standard legal process for non-emergency requests.
4. What information may be available
With appropriate legal process, the information we may be able to provide can include:
- Basic subscriber information — such as the email address associated with the account and the date the account was created.
- Limited content — with appropriate process, limited content that the user provided to the Service.
Persona practices data minimization, collecting and retaining only what is needed to operate the Service. As a result, we may not hold much information responsive to a given request, and some categories of data may not exist. We disclose only what the applicable legal process requires.
5. User notice
Consistent with law and our commitment to transparency, we may notify affected users of a request for their information before disclosing it, so they have an opportunity to respond. We will not provide notice where doing so is legally prohibited, or where we believe notice would endanger a person or the integrity of an investigation.
6. Data retention & preservation
We honor valid preservation requests and will take reasonable steps to preserve a snapshot of relevant account records for a limited period while proper legal process is obtained. A preservation request does not itself compel disclosure; disclosure still requires appropriate legal process.
Outside of a preservation obligation, we retain data only as described in our Privacy Policy. Information may be deleted in the ordinary course of business, so we encourage timely preservation requests.
These guidelines are provided for informational purposes to assist law enforcement. Nothing here is a waiver of any right, objection, or legal protection available to Persona or its users, and we reserve the right to object to or challenge any request as permitted by law.
